Pixelife and Pixelife Photography’s “terms of use” and the associated Privacy Statement outline your rights and responsibilities whilst accessing this site and its content. You should familiarise yourself with these terms, and if you do not agree, then please do not proceed to use the site or its content.

Continued use by accessing/using the website, signifies your consent that you agree to, and are bound by these terms. These terms may periodically be modified, leaving the onus and responsibility for familiarity purely with you.

License and Ownership

The copyright for the content on this website is owned by Pixelife Photography and or its nominee and is protected under the Copyright Act 1968 (Cth) and by other copyright laws in both Australia and other countries. No material on this website may be reproduced, adapted, modified, uploaded to a third party, linked to, framed, displayed in public, distributed or transmitted in any form by any process without the specific written consent of Pixelife Photography. After which time, due credit must be given to each original piece (including author, publication, and Pixelife Photography).

General Conditions of Sale

The following Conditions of Sale shall apply to any product or service sold on this website. These Conditions of Sale constitute a complete and exclusive statement of the agreement and understanding between you and Pixelife Photography with respect to the subject matter hereof.

The goods or services delivered under this agreement shall be of normal quality. Any description of such goods or services has been given by way of identification only and the giving or use of such description shall not constitute any sale hereunder a sale by description.

The products and services available on the website for sale under these Conditions of Sale are only available for sale to individuals who can make legally binding contracts. The products and services are not available to persons under the age of 18 years nor any other person legally prohibited from entering into a binding contract. By placing your order you are verifying to Pixelife Photography that you are able to make a legally binding contract.

Your order is an offer by you to purchase a particular product for the price (including the delivery and other charges and taxes) specified on the website at the time of offer and shall be understood to be placed under these Conditions of Sale.

These Conditions of Sale may change from time to time and you are required within reason to revisit these before placing your order to ensure that these Conditions of Sale have not changed.

Pixelife Photography reserves the right to accept or reject your offer for any reason, including, without limitation, an error in the product description or the price posted on the website, the availability of the product, or an error in your order. Your contract with Pixelife Photography only comes into existence when you receive confirmation of your order, an acceptance of your order, confirmation of receipt of your payment and details of likely delivery.

This contract shall be governed by and construed in accordance with the law in effect in the State of Victoria Australian and by entering into contract both parties are accepting the jurisdiction of the courts or tribunal of the State of Victoria in relation to any dispute between them.

You must inspect any physical goods received upon their arrival and shall within seven (7) days give notice to Pixelife Photography if the goods are not in accordance with specified requirements. If you fail to give such notice, the goods shall be deemed to be in all respects in accordance with the specified requirements. No claim shall be recognised unless made in writing and received by Pixelife Photography within seven (7) days after receipt of goods by you. The total amount of any claim shall not exceed the actual invoice value of the goods claimed to be faulty.

Pixelife Photography is not, and cannot be held responsible for non-delivery or delay of any goods by third parties.

Ownership of Images

All photographs and videos recorded by Pixelife on behalf of a client shall remain the property of the client – when and if full payment for services is received by Pixelife Photography. Use of those images by Pixelife Photography will only take place with the prior consent of the client.

Cancellation & Refund Policy

If you wish to cancel your order, please contact Pixelife Photography immediately. Once payment for an order has been accepted, cancellation is at the discretion of Pixelife Photography.

Cancellation of any orders of services (be they photography, videography, guided tours, training etc.) must be cancelled at least 14 days prior to the scheduled date to obtain a full refund. Requests for refunds between 13 and 7 days prior to the scheduled date will receive only 50% of all monies obtained for those service. Any requests for refunds 6 days or less from the scheduled date shall void all right to a refund.

In the case of gift vouchers purchased from Pixelife Photography, a 100% refund of monies can be obtained only within 14 days of purchase date. No refund will be issued after the 14 days. Vouchers are also non-transferable and cannot be exchanged for monies by the recipient.

Gift Vouchers

Gift vouchers purchased from Pixelife Photography are sent as downloadable vouchers as soon as payment is received. These vouchers are only valid for a 12 months period form the date of purchase; can be used to pay for all or part of any training sessions, workshops, consultations, and photo or video sessions on this site. These vouchers are Vouchers are non-transferable and cannot be exchanged for monies by the recipient.

The amount listed on each voucher is in Australian dollars ($AU).

Disclaimer of Warranties

Pixelife Photography makes no representations or warranties about the accuracy, completeness, security or timeliness of the content, information or services provided by the website and disclaims all warranties, either express or implied, statutory or otherwise, including but not limited to the implied warranties of merchantability, non-infringement of third parties’ rights, and fitness for a particular purpose.
